1. Who we are

Divorce Tutor ("Divorce Tutor," "we," "us") is a self-help document-preparation and educational platform for New Hampshire family-law matters (the "Platform"), operated by Divorce Tutor, PLLC, 708 Pine Street, Manchester, NH 03104. This Privacy Policy ("Privacy Policy") explains how Divorce Tutor collects, uses, and discloses your personal data which means any information that is linked or reasonably linkable to an identified or identifiable individual ("Personal Data"). "Personal Data" does not include de-identified data or publicly available information. This Privacy Policy applies when you use and interact with the Platform.

Divorce Tutor does not act as your attorney or law firm in connection with your use of the Platform and no attorney-client relationship is created by your use of the Platform. See our Terms of Service for additional information.

Please read this Privacy Policy carefully. By using the Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to Divorce Tutor's collection, use and disclosure of Personal Data and other information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the Platform in any way and should immediately exit it. This Policy is incorporated into and subject to our Terms of Service.

Privacy Policy Updates. We may periodically revise this Privacy Policy at any time, by posting an amended Privacy Policy on the Platform. Your continued use of the Platform after any revisions means you consent to and accept the revised Privacy Policy.

2. The information we collect and how we collect it

The following categories of Personal Data and other information may be collected when interacting with the Platform:

We collect Personal Data and other information that you provide.

  • Account Information: email address and password (stored only as a secure hash by our authentication provider), products and services purchased, membership status, forms owned and status.
  • Your profile (information required on Personal Data Sheet): legal name, date of birth, state of birth, home address, mailing address, telephone numbers, email address, social security number (full number for State required form, Certificate of Divorce/Legal Separation/Annulment; otherwise last 4 digits only), signature, employer details, case details including case name/number, court, your role in the case, dates of marriage/separation, number of children, children's date(s) of birth, last four digits of social security numbers, and state(s) of birth. By providing information about your children, you permit us to use that information in accordance with this Privacy Policy and warrant this information as described in our Terms of Service. See Information About Other Parties section in our Terms of Service.
  • Professional and employment information such as employer, occupation, and income including salary, bonus, commissions.
  • Education information such as education level.
  • Health Information as required by the court.
  • Financial Information: bank account numbers (last four digits only), payment card information (complete card number, date of expiration and CVV code), income, expenses, assets, debts, insurance information, tax return information (last 4 digits of social security number for each party and children and business EIN) and other financial information as required by the court.
  • Other information including parenting details and information you upload to the platform such as pay stub, Schedule C, Monthly Expenses form or other information required by the court.
  • Support Requests: messages submitted to us through online forms or email and information entered into your forms if you choose to share that information.
  • Quiz: if you take the What Forms Do I Need quiz and make a purchase, we save the case type and whether children are part of the case.
  • The other party's information: As required by court forms, you may enter the full legal name, date of birth, contact details, employer and other information regarding your spouse or the other party in your case. By providing this information, you permit us to use the data in accordance with this Privacy Policy and warrant this information as described in our Terms of Service. See the Information About Other Parties section in our Terms of Service.

Automatically Collected Information. By choosing to use the Platform, you agree to provide us with certain information, including Personal Data, which is automatically created, collected, and recorded by your use of the Platform (collectively "Usage Information"). The Platform uses third parties, including analytics tools such as Vercel Analytics, to collect Usage Information. Usage Information may include the following:

  • Internet or other electronic network activity information such as IP address, device type and operating system, browser pages viewed and time spent on them, referring website, and date and time stamps.
  • Geolocation data such as non-precise geolocation data collected through your IP address.

To the extent Usage Data reveals your specific identity or relates to an individual, or is combined with Personal Data, we will treat Usage Data as Personal Data.

Sensitive Data. Family-law forms can involve sensitive details (e.g. health, finances, information about children, or domestic-violence matters, and children's Personal Data).

You will need to consent to the collection, use and sharing of such sensitive data by checking the box at sign-up relating to the "sensitive data" opt-in consent which is distinct from consent to our Terms of Service. It is important to note that New Hampshire court files are open to the public other than certain confidential information, such as social security numbers, and Financial Affidavit information, that is specifically exempted from public disclosure. Dates of birth and residence addresses are not exempt from public disclosure (unless there are court ordered restraints and/or a related domestic violence case).

3. Cookies and other automated tools

Divorce Tutor and our third-party service providers use cookies and similar technologies such as access logs and browser local storage (collectively "tracking technologies") to automatically collect information, (including Personal Data), track your interaction with the Platform, and improve the experience with the Platform.

We and our service providers, such as Gavel.io, may use the following types of tracking technologies: (i) strictly necessary cookies which are necessary for the Platform to function; (ii) functional cookies which enhance user experience by remembering preferences and settings in order to personalize Platform interactions; and (iii) a privacy-friendly analytics tool, that does not use cookies, which allows us to count visits and traffic sources so we can measure and improve the performance of the Platform.

Most browsers provide you with the ability to block, delete, or disable cookies. If you choose to reject cookies, some features and functionality of the Platform may be limited or unavailable. 4. How we use your information

We may use Personal Data to:

  • Provide the Platform including to create your account, manage your membership, recommend forms, auto-fill your forms, process payments*, respond to your support requests and other requests.
  • Communicate with you about the Platform including changes to it;
  • Analyze customers' use of the Platform, including the use of cookies and third-party analytics services;
  • Conduct research and analysis for maintaining, securing, developing, and improving the Platform;
  • Conduct business operations, including for security, fraud prevention, legal compliance, and records retention.
  • Protect our rights, privacy, safety and property and the rights, privacy, safety and property of others; and
  • In other ways for which we provide specific notice at the time of collection.

*We use Stripe to process payments and Divorce Tutor does not see or hold payment card information.

5. How We Disclose Information

We may disclose your Personal Data with service providers who perform services on our behalf, such as processing court forms, website hosting, database and file management, email delivery, data analytics, payment processing, and other administrative or operational functions. These service providers are given access to your information only as necessary to perform their services. The categories of service providers to whom we disclose Personal Data are listed in the table below.

We also may share your Personal Data and other information with third parties as follows:

  • to satisfy any applicable law, regulation, legal process or governmental request;
  • to detect, prevent or otherwise address fraud, security or technical issues;
  • to prevent a crime or protect national security;
  • to protect the rights, property or safety of us, our users or others; or
  • in connection with a financing or a sale, acquisition, merger, restructuring or any other transaction involving a change of control in our business, including but not limited to a bankruptcy or similar proceeding.

We do not disclose Personal Data to third parties in situations that qualify as a "sale" or "sharing" (for targeted advertising purposes) under applicable data privacy laws.

6. How we protect your information

We employ administrative, technical, and physical safeguards, such as encryption and access control, to protect Personal Data from unauthorized access, alteration, disclosure, loss, or destruction. Payments are processed through our payment processor who uses Payment Card Industry (PCI) standards to protect that information. However, no e-commerce solution, website, mobile application, database, system, or data transmission is completely secure or hacker-proof and we cannot ensure or warrant the security of Personal Data. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL DATA OR OTHER DATA.

7. How long we keep your information

We will retain your Personal Data and other information for as long as necessary to fulfill the purposes for which it has been collected. We will also retain and use your information as necessary to comply with our legal, accounting and security obligations, resolve disputes, and enforce our agreements. We may retain information that does not identify you indefinitely.

8. Your Choices Regarding Your Data

You have the ability to access and control your Personal Data in the following ways:

  • Access and review your profile and account information.
  • Correct your information subject to certain exemptions. (For example, your legal name and date of birth are associated with your account and you will need to contact support to change this information.)
  • Export a copy of certain data from Account settings → Download your data. The download covers the information in our own systems (your profile, purchases, membership status, form status, and support history). It does not include the answers you entered into your court forms. In order to retain that information, download your completed documents from each form on your dashboard before deleting.
  • Delete your account from Account Settings. Once you choose to delete your account, you have a 5-day grace period during which you can undo the delete by signing back in to your account. After the grace period, we delete your data from our live database and notify Gavel.io to delete the data that they process. Deleted information may remain in encrypted backups for a limited period until those backups expire in the ordinary course. We retain data where required for legal, accounting, or security reasons, to resolve disputes, and to enforce our agreements.

9. Third Party Websites and Services

The Platform may contain links to third-party websites, applications, and services ("Services") that are not owned or controlled by us. Please note that this Privacy Policy does not apply to such Services. You acknowledge and agree that we have no control over, and assume no responsibility for the content, privacy policies, or practices of any Services. We encourage you to review the privacy policies of all the Services you visit or interact with through links on our Site before providing any Personal Data. Your interactions with Services are governed solely by the privacy policies and terms of use of those Services and we bear no liability for any damages or losses arising from your use of or reliance on the content, goods, or services available through such Services.

10. Children's information

The Platform is directed exclusively at adults (individuals at least 18 years old) and we do not intend for it to be used by individuals under the age of 18. We do not knowingly collect information directly from anyone under the age of 13. Information about your minor children that you enter for your court forms is provided by you as the adult account holder, is part of your case data, and is handled as described in this policy. If you are under the age of 18, please do not provide us with any information and promptly exit the Platform.

11. International Transfers

The Platform is operated from our offices in the United States ("U.S."). By using the Platform, or otherwise providing us with any information, you agree that we may process and store your Personal Data in the U.S. and in other jurisdictions. The data privacy laws in the U.S and other jurisdictions where we may process and store information may not be as comprehensive as those in the country where you reside and/or are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to the laws in those jurisdictions.
